Legal
Terms and Conditions
These terms apply to your use of the Omnitech Systems website and to the services we provide. By using our website or accepting a quotation from us, you agree to these terms. Specific project agreements or quotations may include additional terms; where they differ, the signed agreement or accepted quotation applies.
1. About us
Omnitech Systems is based in Montana Mall, Nairobi CBD and provides CCTV and security systems, internet and network installation, Wi-Fi hotspot solutions, websites, software development, digital marketing, business automation and Zoho consulting services.
2. Use of this website
- The information on this website is for general guidance and may change without notice.
- You agree not to misuse the website, attempt to access it without authorisation, or use it for any unlawful purpose.
- Links to other websites are provided for convenience. We are not responsible for their content.
3. Quotations
- Quotations are based on the information available at the time, including any site survey.
- Unless stated otherwise, quotations are valid for 14 days because equipment prices and exchange rates change.
- Work that is not included in the accepted quotation, or changes requested after acceptance, will be quoted and charged separately.
4. Orders and payment
- Work is confirmed once you accept the quotation and pay any deposit stated on it.
- For installations, a deposit may be required before equipment is purchased. The balance is due on completion unless otherwise agreed in writing.
- For software, website and consulting projects, payment may be split into milestones as set out in the quotation or agreement.
- Equipment remains the property of Omnitech Systems until it has been paid for in full.
- Monthly support, hosting and marketing services are billed in advance and continue until cancelled in line with the agreed notice period.
5. Client responsibilities
To help us deliver on time, you agree to:
- Give us safe and reasonable access to the premises at agreed times.
- Provide accurate information, content, logins and approvals when needed.
- Obtain any permissions required from landlords, management or authorities for installations on your premises.
- Use installed systems lawfully, including respecting the privacy of others when operating CCTV.
6. Timelines
We will do our best to meet agreed timelines. Delays caused by late payments, late content or approvals, site access problems, supplier delays or events outside our control may extend the timeline.
7. Warranty
- Equipment is covered by the manufacturer's warranty, as stated on the quotation or invoice.
- Workmanship on installations is covered for the period stated on the quotation. We will correct faults caused by our installation at no extra cost within that period.
- Warranties do not cover damage from power surges, lightning, water, physical damage, misuse, tampering, or repairs by anyone other than Omnitech Systems.
8. Websites, software and digital work
- Ownership and licensing of websites, software and designs are as set out in the quotation or agreement. Unless agreed otherwise, ownership of client-specific work transfers to the client once it has been paid for in full.
- Third-party software, plugins, themes and subscriptions (such as Zoho licences, hosting and domains) remain subject to their providers' own terms and fees.
- You are responsible for making sure that content you provide (text, images, logos) does not infringe anyone else's rights.
- We may show completed work in our portfolio unless you ask us not to.
9. Digital marketing results
We use professional, ethical methods to improve your visibility and results. Because search engines and advertising platforms control their own algorithms, we cannot guarantee specific rankings, traffic or sales.
10. Cancellations
If you cancel a project after acceptance, you will pay for work already done and for any equipment or third-party services already purchased for your project. Deposits may be non-refundable to the extent they cover these costs.
11. Limitation of liability
To the extent permitted by law, Omnitech Systems is not liable for indirect or consequential losses, such as loss of profits, data or business. Security systems help deter and record incidents, but cannot guarantee that theft, loss or damage will not occur. Our total liability for any claim is limited to the amount you paid for the service concerned.
12. Confidentiality
We treat information about your business, systems and premises as confidential and only use it to deliver our services. See our Privacy Policy for how we handle personal data.
13. Governing law
These terms are governed by the laws of Kenya. We will try to resolve any dispute through discussion first. If that fails, the dispute will be handled by the courts of Kenya.
14. Changes to these terms
We may update these terms from time to time. The latest version will always be on this page.
